I – What is GDPR

On May 25, 2018, the General Data Protection Regulation (GDPR) took effect in the European Union. The GDPR governs how both “Data Controllers” and “Data Processors” collect and process “Personal Data” of EU citizens (“data subject”). Based on well recognized privacy principles of accountability, fairness and transparency, GDPR brings long awaited consistency to data protection in the EU by harmonizing the existing patchwork of national data protection legislation across all EU member countries.

III – Legal basis of processing personal data

Under GDPR, there are six different legal bases under which personal data can be processed. It is Enabld policy to identify the appropriate legal basis for data processing and document it. These are briefly described below:

      1. Consent

Enabld will collect and process the personal data with consent by data subjects provide via our website, phone or email. This consent must be revocable at any time.

We collect, process, and use personal data from our site visitors to improve the usability, effectiveness and security of our website and thus provide our site visitors with the best experience. We also collect, process, and use the information you send via contact forms to process requests for information or business inquiries, evaluate job applications, register visitors to events, training sessions or contests, and for other purposes you might have. When you submit your information, you consent to Enabld using such information as described herein.

Purpose of data collection

We collect, process, and store your data to be able to process your request. Whether you are interested in a job opportunity at Enabld, you need software services from Enabld or you wish to provide services to Enabld, we must store your personal data to process your request. We apply the highest level of security when lawfully and fairly collecting, storing and processing adequate, relevant and not excessive personal data.

Data Collection

We collect and process data automatically (through technology) every time you visit our website and both automatically and manually, every time you provide data via our contact forms. We process the data you send to us via the contact forms manually.

Information provided by you that we may collect, processes and use

Enabld does not collect any personal data (personally identifiable information) from you without your knowledge or permission and does not ask you to provide such information to access and use this website. By personal data we mean all the information relating to an identified or identifiable website visitor.

When you provide data via this website or directly via email or phone, we collect, process and use only the personal data you send, and necessary information we need to communicate with you on your inquiries or applications via this website.

If you contact us via the contact form, you consent to having Enabld collect and process the following data:

    • The reason for your inquiry
    • When you submit and inquiry via the contact form, you also consent to having Enabld representatives contact you via email or phone.

If you apply for a job position through our website, you consent to having Enabld collect, process and use the following data:

    • Your name, email address and phone number
    • Your city of residence
    • Your technology stack of interest
    • A message you willingly and knowingly send to us
    • Your CV

When you apply for a job position through our website, you also consent to having Enabld representatives contact you via email or phone.

By using the website, you agree with these terms. Whenever you submit information via the website, you must consent to the collection and use of that information in accordance with this privacy policy.

Collected data

Enabld limits the personal data it processes to information we can use to identify you personally (name, address, phone number, email) so that we can communicate with you. If your inquiry is related to recruitment, we will also process information about your education, professional experience, skills, and anything else that can help our recruiters identify the best matching job for you. If your inquiry is business related, we will also process and record information about your company or business that enables us to assess the fit between our organizations.

      1. Performance of a Contract

Where personal data collected and processed required to fulfil a legal contract with the data subject or to take necessary steps at the request of those concerned prior to entering into a contract, then explicit consent is not required. This also applies where Enabld has signed a legal contract with a client for the provision of our IT and Consultancy services and solutions and the data subjects’ personal data is necessary for completion of the contract. Note that where the client is not an individual, or where the client is not the same person as the data subject, the client will be required to confirm that it has a legal basis for providing the information on the data subject to Enabld.

      1. Legal Obligations

Where Enabld acting as a Data Controller is required to collect and process a data subject’s personal data in order to comply with a legal obligation such as an EU member state’s employment or taxation legislation, then explicit consent is not required from the data subjects to process the data required.

      1. Vital Interests of a Data Subject

Where personal data is required to be processed in order to protect the vital interests of the data subject or of another natural person, then such processing is regarded as lawful under the GDPR. Enabld will retain reasonable documented evidence to cover this case whenever this reason is used as the lawful basis for this type of processing of personal data.

      1. Public Interest Tasks

Where Enabld is required to perform a task that we believe is in the public interest as laid down by law or as part of an official duty, then explicit consent is not required from the data subjects. The assessment of the public interest task or official duty will be documented by Enabld.

      1. Legitimate Interests

If the processing of specific personal data is in the legitimate interests of Enabld and a proportionality assessment is carried out that determines that Enabld legitimate interests are not overridden by the interests or fundamental rights and freedoms of the data subject, then this may be defined as the lawful basis for processing. This will be documented by Enabld.

IV – Rights of those concerned

Each data subject can request to exercise the following rights under the GDPR with respect to the controlling and processing of their personal data:

  • The right to be informed.
  • The right to access the personal data processed.
  • The right to rectification of inaccurate personal data concerning him or her.
  • The right to erasure of the personal data where there are legitimate grounds for retaining it.
  • The right to restrict processing.
  • The right to receive the personal data provided to a controller concerning him or her (data portability).
  • The right to object processing of personal data concerning him or her.
  • The right not to be subject to automated decision making and profiling rights.

Requests to exercise these rights should be generally handled in one month.

V – Breach notification

GDPR requires Enabld to notify relevant Data Protection Authorities (DPAs) within 72 hours of becoming aware of a personal data breach unless the breach is unlikely to result in a risk to the rights and freedoms of impacted data subjects. Enabld must also notify impacted data subjects without undue delay when a high risk to rights and freedoms is likely. Enabld as a processor must notify their clients (data Controller) of a data breach without undue delay. As Enabld is established in the Republic of Moldova (EU Associated Country), the National Center for Personal Data Protection (www.datepersonale.md) is Enabld lead authority.

VI – Data Storage at Enabld

The personal information you have provided to us is processed and stored for the particular purpose is collected for as long as the particular purpose is valid and after this for a limited time due to our purposely determined back-up and deletion routines.

VII – Data transfer to third parties

The data you provide is shared directly with third parties only if we are legally required to do, such as in case of law enforcement or security. We will never share or sell your data to gain advantage or profit.

VIII – Security

Protecting your information is one of our primary concern. The information that we collect is stored on secure servers. We take reasonable precautions to protect your personal information.
